1. Agreement to Terms
By accessing or using DonorFlow AI ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use the Service. DonorFlow AI is operated by DonorFlow AI, Inc. ("we," "us," or "our").
2. Description of Service
DonorFlow AI provides donor management, retention analytics, campaign tools, and AI-powered insights for nonprofit organizations. The Service includes web-based software, data processing, email delivery, and related support services.
3. Account Registration
You must provide accurate, complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be authorized to act on behalf of the nonprofit organization you represent.
4. Subscription & Billing
The Service offers a free tier and paid premium plans. Free accounts are limited to 2,000 donor records. Premium features require a valid payment method. Billing cycles are monthly or annual, as selected at checkout. You may cancel your subscription at any time; access continues until the end of the current billing period. No refunds are provided for partial months.
5. Acceptable Use
You agree not to: (a) use the Service for any illegal purpose; (b) upload viruses or malicious code; (c) attempt to gain unauthorized access to the Service or related systems; (d) interfere with other users' access; (e) send unsolicited communications in violation of anti-spam laws; (f) resell or sublicense the Service without written permission.
6. Data & Content
You retain ownership of all donor data and content you upload. You grant us a limited license to process, store, and analyze this data solely to provide and improve the Service. We will not sell your donor data to third parties. See our Privacy Policy for details on how we handle personal information.
7. AI-Generated Content
The Service uses artificial intelligence to generate campaign content, insights, and recommendations. You are responsible for reviewing and approving all AI-generated content before sending it to donors. We do not guarantee the accuracy, appropriateness, or effectiveness of AI-generated outputs.
8. Confidentiality
We treat your donor data as confidential. Our staff access your data only when necessary for support, security, or legal compliance. All staff with data access are bound by confidentiality obligations.
9. Termination
We may suspend or terminate your account if you violate these Terms or if required by law. Upon termination, we will retain your data for 30 days to allow export, then permanently delete it, except where longer retention is required by law.
10. Disclaimer of Warranties
The Service is provided "as is" without warranties of any kind. We do not guarantee that the Service will meet your specific requirements, be uninterrupted, timely, secure, or error-free.
11. Limitation of Liability
To the maximum extent permitted by law, our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
12. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Delaware.
13. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance.
